How Far Should Business Partner Loyalty Go?

By Nina Kaufman, Esq.

I was interviewed earlier this week by a Canadian paper for comments on the latest cause celebre, the trial of former media magnate Canadian Conrad Black, for charges of racketeering, to mail fraud, and tax evasion. The trial opened in Chicago in mid-March.

The most interesting twist is that the government’s star witness is none other than . . . Black’s business partner of 38 years, David Radler! Seems that Radler was presented with a classic Hobson’s choice: work out a plea agreement or testify against (“rat out”?) your partner and possibly join him in facing 101 years in prison if convicted on all counts. Radler chose the plea, and will be sentenced to no more than 29 months in prison.
